This End User License Agreement (the "Agreement") is concluded between ARTISMEDIA Sp. z o.o. (the "Licensor") and the organization or person that installs or uses the Application on its Bitrix24 account (the "Licensee").
By installing or using the Application you accept this Agreement. If you do not agree, do not install or use the Application. If you accept on behalf of an organization, you confirm that you are authorised to bind it.
1. Definitions
1.1. Application — the Pulse24 software provided as a cloud service for building sales analytics from the CRM data of a Bitrix24 account, including updates and documentation.
1.2. Bitrix24 account — the Licensee's cloud Bitrix24 workspace or on-premise Bitrix24 installation on which the Application is installed.
1.3. Marketplace — the Bitrix24 Marketplace through which the Application is distributed.
1.4. Aggregated figures — numeric results of the calculation that contain no client details or texts: counts and amounts of deals by stage, month and responsible person ID, and the numeric deal index (deal ID, stage, responsible person ID, date and amount).
2. What the Application does
2.1. The Application reads, through the Bitrix24 REST API and in read-only mode, the deals, deal stages and pipelines, currencies and exchange rates, deal stage history, active employees and the company structure of the Bitrix24 account, and on this basis: shows the sales funnel by stage with deal counts and amounts; calculates conversion based on actual transitions between stages and the median and average time deals spend at each stage; shows figures by responsible person and period; converts amounts in different currencies into the base currency of the Bitrix24 account at the exchange rates set there; lets users open the list of deals behind a figure and the deal itself in the CRM; and limits what each user sees according to the company structure.
2.2. The calculation runs on the Licensor's servers using data received from the Bitrix24 account at the time of calculation. Only Aggregated figures are kept afterwards; deal titles, client details, contact data and other CRM content are not stored. Details are set out in the Privacy Policy.
2.3. The specific set of features is determined by the current version of the Application and its description in the Marketplace.
3. License grant
3.1. The Licensor grants the Licensee a non-exclusive, non-transferable, worldwide, revocable license to use the Application on the Licensee's Bitrix24 account for its internal business purposes for as long as the Application is installed and, where a fee applies, paid for.
3.2. The number of Bitrix24 users who may access the Application is not limited by the Licensor; it is determined by the Licensee's Bitrix24 plan. The number of reports is not limited, except by the technical limits of the Bitrix24 REST API and reasonable measures to avoid overloading the Licensee's Bitrix24 account.
3.3. The Licensee may use the figures and reports produced by the Application without restriction, including for commercial purposes and management decisions.
3.4. All intellectual property rights in the Application remain with the Licensor. No rights are granted except those expressly stated.
4. Fees
4.1. The price and any trial period of the Application are those shown on its Marketplace listing at the time of installation. If the Application is offered free of charge, no fee is due; optional paid features, if introduced, will be offered separately and will never be charged without the Licensee's explicit consent.
4.2. Where a fee applies, it is paid through the Marketplace. Payment processing, billing periods and payment documents are handled by the Marketplace operator; the Licensor does not collect payments directly. Refunds follow the Marketplace rules and mandatory law.
4.3. When a paid subscription ends and is not renewed, access to the Application is suspended. The Licensee's CRM data is not affected: the Application never changes or deletes it.
5. Restrictions
The Licensee shall not: (a) copy, modify, decompile or reverse engineer the Application except as permitted by mandatory law; (b) resell, sublicense or provide the Application to third parties as a service; (c) circumvent security or access controls; (d) use the Application to violate the law or the rights of others; (e) interfere with the Application's operation or overload it.
6. Licensee's responsibilities
6.1. The Licensee is responsible for the data entered into its Bitrix24 account and for having a lawful basis to process the personal data it contains, including informing employees and clients as required by the GDPR.
6.2. The Licensee is responsible for the access rights it grants to its users in Bitrix24, for the correctness of its company structure and department heads, and for keeping any inbound webhook it connects to the Application secure.
7. Visibility of figures
7.1. The Application limits what each user sees according to the company structure of the Bitrix24 account: a Bitrix24 administrator sees figures for all deals; a department head sees their department and all its sub-departments; other employees see only the deals for which they are the responsible person.
7.2. The user's identity is confirmed by Bitrix24. These limits apply both to aggregated figures and to the deal lists opened from them.
7.3. The Application's visibility rules do not replace or override the access rights set in Bitrix24. If the company structure cannot be read, the Application says so and applies the most restrictive option: department heads see only their own deals.
8. On-premise Bitrix24
On an on-premise Bitrix24 that is not connected to the Bitrix24 Network, Bitrix24 gives the Application an access key only while a user has the Application open. Background updates of the figures on such an account are therefore possible only if the Licensee connects an inbound webhook through the Application. Until then, figures are calculated when the Application is opened. The Application informs the Licensee of this limitation on first launch. Background calculation through a webhook sees only the CRM data available to the employee who created the webhook.
9. Personal data
Personal data is processed in accordance with the Pulse24 Privacy Policy (https://pulse-eu.ai-automation-agency.biz/legal/privacy). Its Section 11 (Data Processing Terms under Article 28 GDPR) forms an integral part of this Agreement.
10. Availability, support and updates
10.1. The Licensor makes reasonable efforts to keep the Application available but does not guarantee uninterrupted or error-free operation. Maintenance may cause short interruptions.
10.2. Support is provided by e-mail at artismediaeu@gmail.com, Monday–Friday, 9:00–18:00 CET, in English, Polish or Russian. We aim to respond within two business days. Support covers questions about the Application's features, help with visibility rules and connecting an inbound webhook on on-premise Bitrix24, and diagnosing and fixing errors of the Application. It does not cover setting up or repairing the Licensee's Bitrix24, custom development or custom reports.
10.3. Updates are installed by the Licensor automatically and at no extra charge. This Agreement applies to all updates.
10.4. The Application depends on Bitrix24 and its REST API; changes, limits or outages of Bitrix24 are outside the Licensor's control.
11. Warranty disclaimer
11.1. To the maximum extent permitted by law, the Application is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
11.2. The figures are calculated from the data in the Licensee's CRM; their accuracy depends on how completely and correctly the CRM is maintained. The Application is an analytical tool and does not replace accounting, tax or legal advice. The Licensor is not responsible for management decisions made on the basis of the figures, or for differences between the Application's figures and Bitrix24 reports caused by different filters, periods or settings.
12. Limitation of liability
12.1. To the maximum extent permitted by law, the Licensor shall not be liable for indirect or consequential damages, lost profits, lost data or business interruption.
12.2. The Licensor's total liability under this Agreement is limited to EUR 100 or the amount paid by the Licensee for the Application in the preceding 12 months, whichever is greater.
12.3. Nothing in this Agreement limits liability for damage caused intentionally, or any liability that cannot be limited under applicable law, including the rights of consumers.
13. Term and termination
13.1. This Agreement is effective from installation until the Application is uninstalled.
13.2. The Licensee may terminate at any time by uninstalling the Application.
13.3. The Licensor may suspend or terminate access for material breach of this Agreement, or discontinue the Application with at least 30 days' notice.
13.4. Upon uninstall, data is deleted as described in the Privacy Policy.
14. Changes
The Licensor may update this Agreement. The current version is published at https://pulse-eu.ai-automation-agency.biz/legal/license. Material changes take effect no earlier than 30 days after publication; continued use after that date means acceptance.
15. Governing law and disputes
15.1. This Agreement is governed by the laws of the Republic of Poland, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.
15.2. Disputes shall be resolved by the common court competent for the Licensor's registered office in Warsaw, unless mandatory law provides otherwise (in particular for consumers).
16. Miscellaneous
16.1. If any provision is held invalid, the remaining provisions remain in force.
16.2. This Agreement, together with the Privacy Policy, constitutes the entire agreement regarding the Application.
16.3. In case of discrepancies between language versions, the English version prevails.
